01 Acceptance of terms

H Marketing is a full-stack digital marketing agency based in Laguna Beach, California. We provide brand identity and positioning, website design and development, SEO, social media management, cinematic video production, CRM and marketing automation, sales funnels and lead capture, and paid advertising on platforms such as Meta and Google.

The website provides general information about these services. Nothing on the website constitutes a binding offer, and the specific scope, deliverables, and fees for any engagement are defined in a separate written agreement or proposal.

03 Eligibility

You must be at least 18 years old and able to form a legally binding contract to use our services. If you use the website or engage us on behalf of a business or other entity, you represent that you have the authority to bind that entity to these Terms.

Client deliverables

Ownership of work products we create for clients (such as brand assets, websites, and creative) is addressed in the applicable service agreement. Unless otherwise agreed, ownership of final deliverables typically transfers upon full payment. We may retain the right to display completed work in our portfolio and marketing unless a client requests otherwise in writing.

06 Client engagements

When you engage H Marketing, the specific services, timelines, and fees are set out in a proposal, statement of work, or service agreement. Those documents, together with these Terms, form the agreement between us. If there is a conflict between these Terms and a signed service agreement, the signed service agreement controls for that engagement.

Delivering effective marketing depends on collaboration. You agree to provide timely access to accounts, assets, approvals, and information reasonably needed for us to perform the services.

07 Payments & billing

Fees, setup costs, and billing cycles are described in your service agreement and reflect the plans outlined on our Pricing page. Unless stated otherwise:

• Monthly service fees are billed in advance and any one-time setup fees are due at the start of the engagement.
• Payments are non-refundable except where required by law or expressly stated in your agreement.
• Third-party costs, such as ad spend, are your responsibility unless we agree otherwise in writing.
• Late or missed payments may result in paused work or suspension of services.

Prices shown on the website are for general guidance and may change. Custom (Authority) pricing is confirmed by consultation.

08 Our guarantee

We stand behind our work. As described on our website, if we don't deliver the results agreed upon in your service agreement within the stated timeframe, we'll keep working at no additional service charge until we do.

09 Third-party platforms

Our services rely on third-party platforms and tools, including GoHighLevel, Google, Meta, and others. Your use of those platforms is subject to their own terms and policies. We are not responsible for the availability, performance, policy changes, or actions of third-party providers, though we work to manage them responsibly on your behalf.

10 Electronic communications & SMS

By providing your contact information, you consent to receive communications from us electronically, including transactional messages and, where you have opted in, marketing emails and text messages. See our Privacy Policy for details on how we collect and use your information.

SMS/text messaging program

If you opt in to our SMS program, you agree to receive text messages from H Marketing at the mobile number you provide. Depending on how you interact with us, these messages may include:

• Alerts & transactional messages — appointment confirmations, reminders, and updates related to your engagement.
• Notifications — service updates, follow-ups, and responses to your questions or requests.
• Promotions & marketing — offers, announcements, and other promotional messages, where you have opted in.

Message frequency varies based on your interactions with us. You can opt out of marketing texts at any time by replying STOP to any message, and reply HELP for assistance. You can also unsubscribe from marketing emails using the link in any email.

11 Disclaimers

Our website and services are provided on an "as is" and "as available" basis. While we bring real expertise and effort to every engagement, marketing results depend on many factors outside our control, including your market, budget, offer, and responsiveness.

Except for any specific guarantee expressly stated in your written agreement, we make no warranties of any kind, express or implied, regarding specific results, revenue, rankings, traffic, or uninterrupted or error-free operation of the website.

12 Limitation of liability

To the fullest extent permitted by law, H Marketing and its team will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of your use of the website or services.

Our total liability for any claim arising out of or relating to the services will not exceed the amount you paid to us for the services giving rise to the claim during the three (3) months preceding the event that gave rise to the liability.

13 Indemnification

You agree to indemnify and hold harmless H Marketing and its team from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the services, your violation of these Terms, or your infringement of any third-party rights, including any content or materials you provide to us.

Any disputes arising out of or relating to these Terms or our services will be subject to the exclusive jurisdiction of the state and federal courts located in Orange County, California.
